Mock Trial: Hobert v. Rogers --- 8 PDH's (3 ethics)

Plaintiff Jesse Hobert was granted a private right of way easement by the Texas Supreme Court in order to access his lots in Mohawk Lake Subdivision. The easement is over Daniel Vincent’s 200 acres which completely surround Mohawk Lake and Mohawk Lake Subdivision.

Defendant Charles Rogers believes - based on the results of a survey by Foster - that the drive Hobert constructed actually crosses the back of his (Rogers’) lots, and is not on Vincent’s property.

To the contrary, Hobert’s surveyor (Meyers) believes that the back lot lines involved are some 30 to 40 feet closer to the lake than where surveyor Foster set the line. Therefore, Hobert claims his drive is not, in fact, on Rogers’ property, but rather it lies within Vincent’s property, where it is supposed to be, and that Rogers has been unlawfully interfering with use of his easement. Both surveyors provide seemingly credible justification for how they resolved the lot lines.

The audience will be divided into juries of 6 after the trial so each jury can deliberate. The results of the deliberations will then be discussed and various aspects the trial (which is an actual case that went to trial) explored in detail.


Gary Kent Professional Surveyor

Gary Kent, PS is a Professional Surveyor with Schneider Geomatics in Indianapolis. After 37 years, he transitioned to part-time in 2020 and formed Meridian Land Consulting through which he provides training, consulting, and expert witness services.

Gary was Chair of the ALTA/NSPS Workgroup responsible for the ALTA/NSPS Standards for 26 years from 1995 to 2021. He has presented programs on boundaries, standards, risk management, safety, easements, leadership, and other topics multiple times in all 50 states. Gary has served on the Indiana State Board of Registration for Professional Surveyors since 2004 and is a past-president of both ACSM and the Indiana Society of Professional Land Surveyors.

During his tenure, he was instrumental in driving GeoShack’s national presence managing the e-commerce, building construction, and GeoPositioning divisions. His hands-on expertise with Topcon systems, coupled with a customer-first mindset, established him as a trusted advisor with customers all over the US.

At MultiCopter Warehouse, Thad leads national sales operations. He is focused on building a high-performance sales team, expanding market share, and transitioning customers toward American-made drone platforms in response to evolving regulatory trends.

When he is not immersed with his family & friends, Thad enjoys hunting, fishing, and following sports, especially college football.

Timothy W. Burch PLS, Executive Director of the National Society of Professional Surveyors (NSPS)

Timothy W. Burch, PLS is an Executive Director at the National Society of Professional Surveyors (NSPS). He also served as the President-Elect, Vice President, and Secretary (2015-2019) of the NSPS Board of Directors, and as Governor/Director representing Illinois (2007-2014). Tim has been involved with the organization for more than 20 years as a member of the Certified Survey Technician Board, Joint Government Affairs, and ALTA/NSPS Land Title Survey committees.

Tim serves as Chair for the International Federation of Surveyors (FIG) Commission 1 (Professional Standards, 2023-2026) and serves as the Advisory Committee of the Commission Chairs representative to the FIG Council. He also led the local organizing group in partnering with FIG to host the annual Working Week 2023 in Orlando.

As part of his role as NSPS Executive Director, Tim serves as association liaison to the International Property Measurement Standards and International Ethics Standards working groups as well as maintaining communication with like-minded surveying associations from around the world.

In addition to content manager for NSPS social media, Tim is the creator and producer of the NSPS podcast “Surveyor Says!” and the managing editor for both the NSPS newsletter “News and Views” and the recently introduced “Surveyor Says! The NSPS Bulletin”. He also serves as a Brand Ambassador for the “Get Kids into Survey” (GKIS) initiative created by Elaine Ball and was instrumental in establishing NSPS as the North America distributor for the GKIS posters and educational material.

Mr. Burch is a Professional Land Surveyor licensed in the States of Illinois and Wisconsin. He recently relocated with his wife, Susan, to West Virginia after many years in Illinois.
